SAPOON, crafts for manufacturing, services, and trade, owned by Marta Perinić, with its registered office in Zagreb, Ulica Franje Horvata Kiša 3, MBO: 98229885 (hereinafter: SAPOON), provides an interactive online service through internet pages on the domain www.sapoon-noir.com. The service consists of providing information services and content management. For the purpose of these Terms of Use, the term “Internet Pages” refers to all web pages located within the domain www.sapoon-noir.com. These Terms of Use prescribe the terms and rules relating to the use of the Internet Pages by End Users.
By using and accessing these Internet Pages (except for the first reading of these Terms), End Users declare that they have read and understood the Terms of Use, that they are familiar with them and fully agree with the terms and rules stated herein, and consent to the use of the Internet Pages in accordance with them.
The right to use the Internet Pages is not transferable to other physical or legal entities. The End User is personally responsible for protecting the confidentiality of passwords where they exist as such.
The End User is aware of the fact of occasional interruptions, unavailability, and/or disconnection of services (routine maintenance, etc.), force majeure events, and SAPOON is not liable for any loss of data that may occur during the transmission of information on the Internet. The End User agrees and accepts that due to the stated reasons, access to the Internet Pages may be interrupted, temporarily unavailable, or disconnected.
Information on this website may contain technical inaccuracies or typographical errors. SAPOON does not represent or warrant, expressly or impliedly, that the content of the Internet Page and/or related pages is complete or updated; that the Internet Page and/or related pages will always be accessible and available, or that they will not cause damage to users, registered users, or third parties. Each user and registered user expressly accepts the use of this Internet Page at their own risk and solely bears all potential costs related to the maintenance or repair of computer equipment. Any warranty given on these pages relates exclusively to products or services provided by SAPOON.
SAPOON reserves the right at any time to modify or discontinue the Internet Page, including, but not limited to, content, time of availability, as well as the equipment required to access or use the pages. SAPOON is authorized to stop publishing any part/type of information and change or discontinue any method of data transmission, change data transmission speeds, as well as any of their other characteristics. Information may be changed without prior notice. SAPOON may also at any time make improvements and/or changes to the products and/or programs described in this information, without prior notice. If the User does not accept the Terms of Use, they are obliged to refrain from using the Internet Pages.
SAPOON reserves the right to revise the Terms of Use at any time as well as to terminate access to the Internet Pages without prior notice.
SAPOON reserves the right at any time, if it deems it necessary, to cancel or modify any of the Terms of Use and/or the Privacy Statement stated here. Any modification or termination of the terms and rules of use will take effect immediately upon publication on the internet pages. Any use of these Internet Pages by the End User after such notice will be deemed acceptance of those changes.
The User undertakes to periodically reread the Terms of Use to become familiar with any changes. If the User uses the Internet Pages after the modification of the Terms of Use, it is presumed that they are familiar with the modifications, understand them, and fully accept them. We exclude liability for any damage caused to users, registered users, or third parties as a result of such modifications.
The End User is solely and exclusively responsible for the procurement, use, and maintenance of their computer equipment, including but not limited to all software and hardware they own and use, as well as other equipment required to access and use the Internet Pages of SAPOON, and all associated costs. SAPOON is not responsible for any damage to the End User’s equipment that may occur as a result of using these Internet Pages.
These Internet Pages, as well as any other pages now or later contained, or otherwise accessible via external links from the Internet Pages, are the private property of SAPOON.
All mutual interaction taking place through these Internet Pages must be in accordance with the Terms of Use, and users are required to ensure all activities related to the use of these Internet Pages comply with the positive legal regulations of the Republic of Croatia.
It is forbidden to publish, use, transmit, send, and exchange materials and content that violate or threaten privacy, or are vulgar or otherwise undesirable in normal communication, which threaten and/or violate the rights of others, and in particular materials and content that are by their nature unlawful, threatening, abusive, defamatory, which violate the valid legal regulations of the Republic of Croatia, especially illegal, false or untrue, misleading, offensive, defamatory, vulgar, obscene, threatening, disturbing, racist, or chauvinistic content, content that violates the intellectual property rights of third parties, content that unauthorizedly discloses personal data or violates the right to personality of third parties or other users, as well as other inappropriate content, and content that may cause damage to SAPOON and connected companies, other users, or third parties, which includes, among other things, content that encourages behavior that constitutes a criminal offense, entails civil liability, or otherwise violates any regulation and which, without the express, prior, written approval of SAPOON, contains advertising or an offer of anyone’s products and services. The End User may not use these Internet Pages to advertise or perform any commercial, religious, political, or non-commercial promotion, including inviting users of these Internet Pages to become members of another online or offline service that represents direct or indirect competition, or potential competition to SAPOON.
Any conduct by End Users which, in the discretionary assessment of SAPOON, restricts or prevents any other end user from using the Internet Pages is strictly prohibited.
These Internet Pages contain materials protected by copyright, trademark, design, and other information covered by other rights of physical or legal entities, including, but not limited to, texts, software, photos, video materials, graphics, music, sound, as well as the entire content of the Internet Pages, in accordance with the regulations of the Republic of Croatia. All materials (texts, photos, images, drawings, audio and video materials, etc.), protected product and service marks (trademarks), logos, and other content located on the Internet Pages are the exclusive right of SAPOON, or are used with the express approval of the copyright holder and trademark and/or design rights holder. Unless otherwise stated, all other trademarks appearing on the system are the intellectual property of their respective holders. SAPOON is the copyright holder regarding the selection, coordination, placement, and improvement of such content, as well as rights regarding original content.
Any copying, distribution, transmission, publication, reproduction, modification, revision, transferring, linking, deep linking, creation of derivative works, or otherwise changing these internet pages without the express written approval of SAPOON is strictly prohibited.
Any violation of these terms may result in copyright, trademark, or other intellectual property rights infringement and may lead to civil, commercial proceedings and/or criminal and/or misdemeanor prosecution against the perpetrator. Copying, redistribution, retransmission, publication, or commercial exploitation of downloaded material is not permitted without the express written approval of SAPOON and the copyright holder.
The End User may download, print, and save copyrighted materials only for their own personal use. The use and printing of content from the Internet Pages is permitted exclusively for information and personal, non-commercial purposes of the user.
The End User undertakes not to post, publish, or otherwise make available on these Internet Pages any material subject to copyright, trademark, or other intellectual property rights without the express approval of the holder of those rights. The End User is solely and exclusively responsible for damage that may result from copyright infringements, misuse of trademarks and other intellectual property rights, or any problems arising in connection with the publication of such materials.
SAPOON bears no obligation to inform the End User or assist them in determining whether a certain material is subject to copyright.
By posting material on any publicly accessible part of these Internet Pages, the End User guarantees under criminal and material liability that they are the holder of rights to these materials and gives SAPOON an express, free, permanent, irrevocable, non-exclusive right to use, publish, duplicate, reproduce, modify, adapt, distribute, publish, translate, and/or distribute such material (in part or in whole) worldwide for an indefinite period and duration. The End User also grants other end users the right to access, view, save, or reproduce that material for their own use.
The terms stated in this Chapter apply equally to the benefit of SAPOON, as well as its subsidiaries, affiliates, and third-party service providers and licensed companies, and each of them has the right to directly enforce these terms in their own name.
By publishing on or through the Internet Pages, the End User has given SAPOON a free, spatially and temporally unlimited license to use, reproduce, modify, publish, adapt, translate, distribute, perform, and display that communication, alone or as part of a larger whole, in any form, on any medium or via any technology, whether known or later developed, and to share such rights with multiple sub-licensees.
By using or accessing this page, the User does not acquire, explicitly or implicitly, any license or right to use a trademark, patent, design, copyright, or other right belonging to SAPOON and/or a third party. Users and registered users bear their own responsibility for respecting copyright and other intellectual property rights regarding those contents.
Products are sold as souvenirs. We assume no responsibility for the way you use the product. Product descriptions are not medical advice nor advice for diagnosing or treating pre-existing health conditions. Publications stated on the SAPOON webshop or our social networks cannot be considered a sufficient basis for making medical, personal, financial, or business decisions. SAPOON does not guarantee that product photos fully correspond to the appearance of the product itself. Although all descriptions are regularly and thoroughly checked, we are not responsible for possible unintentional errors in the product description.
The End User expressly agrees that the use of these internet pages is exclusively at the end user’s own risk. Neither SAPOON, its subsidiaries, parent companies, nor any of their employees, agents, third-party service providers, or licensed companies warrant that the use of this internet page will be uninterrupted or error-free; nor do they warrant (i) the consequences that may arise from the use of this internet page, or (ii) the accuracy, reliability, or content of any information, service, or merchandise provided through these internet pages.
This liability disclaimer applies to all damages, direct or indirect, or possible injuries caused by any bad traits, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft, destruction, or unauthorized access, alterations, or misuse of records, termination of contract, inappropriate behavior, negligence, or any other action. The End User expressly confirms that SAPOON is not responsible for the offensive, inappropriate, or illegal behavior of other users or third parties and that the risk of damage that may arise as a result of the foregoing lies entirely with the end user.
In no case will SAPOON, or another physical or legal entity involved in creating, producing, or distributing these internet pages, or related content, as well as any software, be liable for any damage that may arise as a result of the use, or due to the inability to use these internet pages. The End User expressly confirms that the terms of this chapter apply to the entire content of these internet pages.
In addition to the previously stated terms, neither SAPOON, nor the parent company, nor its subsidiaries, information providers, or partners who edit content, will be liable, regardless of the cause or duration, for any errors, inaccuracies, or other defects, inappropriateness or inauthenticity of information found on these internet pages, as well as for any delay or interruption in the transmission of information to the end user, for any claims or losses arising therefrom. None of the above-mentioned parties will be liable for any third-party claims or losses, including lost profits.
SAPOON is not responsible for any content that a user, subscriber, or unauthorized user may post on these internet pages. Any content that is posted and which is or can be considered inappropriate can be removed by SAPOON at any time.
SAPOON reserves the right to change, adapt, modify, delete, or remove any content it deems inappropriate. SAPOON is in no case liable to anyone for any direct, indirect, special, or consequential damage from the use of this or other websites, including, without limitation, loss of profit, business interruption, loss of programs or other data on your data processing systems or otherwise, even when we are explicitly informed of such damages.
SAPOON reserves the right to immediately terminate any passwords or user accounts of the End User in the event of any behavior by the End User which SAPOON, in its discretionary assessment, considers unacceptable, as well as in any case of non-compliance with these Terms by the End User. In the event of termination of passwords or User accounts, the terms shall not cease to apply between the End User and SAPOON.
All payments processed on www.sapoon-noir.com are securely handled via Stripe. SAPOON does not store, see, or have access to your full credit card or payment method details. All transactions are encrypted using Secure Socket Layer (SSL) technology and comply with the Payment Card Industry Data Security Standard (PCI-DSS).
Shipping & Delivery Policy
Delivery is available within the European Union. Estimated delivery time is 3–7 business days after payment confirmation, subject to stock availability. All shipments are calculated and displayed at checkout.

🔄 Returns, Cancellations, and Refund Policy
Cancellations: You may cancel your order within 24 hours of purchase, provided the item has not yet been shipped. Please contact us immediately at shop@sapoon-noir.com.
Returns: Because our products are categorized as hygiene/cosmetic souvenirs, we can only accept returns on items that are unopened, unused, and in their original packaging due to health and safety regulations. You have 14 days from the date of delivery to request a return.
Refunds: Once your return is received and inspected, we will send you an email to notify you of the approval or rejection of your refund. If approved, your refund will be processed, and a credit will automatically be applied to your original method of payment within 5–10 business days.
Damaged Items: If you receive a damaged product, please contact our support team at shop@sapoon-noir.com with photographic evidence within 48 hours of delivery to arrange a replacement or refund.

The merchant outlet country and legal domicile of SAPOON is Croatia (European Union). All transactions are subject to applicable Croatian and EU consumer laws.
SAPOON has the right, but not the obligation, at all times to monitor the content on these Internet Pages, including any chat rooms and forums that might be contained as part of these Internet Pages, to ensure compliance with these Terms of Use, as well as any other rules prescribed by SAPOON, and compliance with any applicable law, regulation, or other act. The End User confirms that all comments, private messages, forums, chat rooms, and/or other methods of sending messages or mutual communication (hereinafter referred to as—Communities) are public, not private in nature, and therefore SAPOON employees can monitor the communications of end users without their knowledge and explicit permission.
SAPOON does not control and/or authorize the content, messages, or information found in any communities and therefore is not responsible for any actions resulting from the end user’s participation in any of the Communities, including liability for possible disputed content.
SAPOON does not wish to receive confidential or proprietary information from the User through this website. Any information or material sent to SAPOON will be treated as NOT confidential. By sending some information or material to SAPOON, as a User you give SAPOON an unrestricted and irrevocable license to use, copy, display, perform, modify, transmit, and distribute those materials or information, and also agree that SAPOON is free to use any ideas, concepts, knowledge, or techniques for any purpose.
However, SAPOON will not publish the User’s name or otherwise publicize the fact that the User sent materials or other information, unless: (a) we obtain the User’s permission to use your name; or (b) we first notify the User that the materials or other information sent to a specific part of these pages will be published or otherwise used on them together with your name; or (c) we are obliged to do so by law.
Any type of communication by the end user is considered non-confidential. If specific web pages allow the publication of communications that SAPOON will treat as confidential, that fact will be stated on those pages.

The End User agrees to indemnify, defend, and hold harmless SAPOON, parent companies, its subsidiaries, their responsible persons, employees, and agents from all claims for damages and costs, including costs of legal representation, which may arise from the use of these Internet Pages by the End User.
SAPOON, like Internet Service Providers (ISP), is a distributor (and not a publisher) of content provided by third parties and End Users. Any opinions, advice, statements, services, offers, or other information or content posted by third parties, including public information providers, or any end users, come from the respective authors or distributors and not from SAPOON, nor do third-party information providers guarantee the accuracy, completeness, or usefulness of any content, nor its merchantability or fitness for any particular purpose.
Information available on the Internet Pages, which represents the opinions and assessments of the respective information provider, end user, or other user who is not in a contractual relationship with SAPOON, is not authorized by SAPOON and therefore SAPOON cannot be responsible for the accuracy or reliability of any opinion, advice, or statement published on the internet pages by anyone who is not an authorized employee of SAPOON, or who does not act in an official capacity. Under no circumstances will SAPOON be liable for any loss or damage caused by the end user relying on information obtained through the Internet pages. These links are provided solely for convenience and not as an endorsement by SAPOON of the content on third-party pages, and SAPOON expressly disclaims any connection with the content or accuracy of materials on third-party internet pages.
In the event of the invalidity of individual provisions of the Terms of Use, such invalidity shall not affect the validity of any other provision of these Terms, and the remaining parts of these Terms shall remain in force.
If either party fails to exercise its rights under these Terms, this shall not be considered a waiver or loss of the same rights in the future, nor of any other rights specified by the Terms.
For everything not regulated by this Agreement, the provisions of the Civil Obligations Act shall apply.
The contracting parties will attempt to resolve all disputes arising from this Agreement amicably. All disputes or claims that may arise as a result of using these Internet Pages, in connection with these Terms, or in connection with their enforcement, are under the jurisdiction of the court in Zagreb, with the application of the relevant material Croatian law.
These terms of use apply from October 1, 2022, until revoked by SAPOON.
By accessing and/or using the Internet Pages of SAPOON, the User confirms that they have read, understood, and agree to the Data Confidentiality Terms and methods of using SAPOON Internet Pages. If the User does not agree with them, they are obliged to refrain from using them, leave them, and not access and/or use the Internet Pages of SAPOON.
SAPOON is authorized to modify the Data Privacy Statement at any time by publishing the amended text of the statement on SAPOON Internet Pages. Modifications to the privacy statement take effect immediately upon publication on the Internet Pages. Any use of these Internet Pages by the End User after such notice will be deemed acceptance of those changes.
The User undertakes to periodically reread the Privacy Statement to become familiar with any changes. If the User uses the Internet Pages after the modification of the Privacy Statement, it is presumed that they are familiar with the modifications, understand them, and fully accept them. We exclude liability for any damage caused to users, registered users, or third parties as a result of such modifications.
SAPOON collects personal information that identifies Users of the Internet Pages. When a User engages in certain activities on SAPOON Internet Pages, such as opening a user account, subscribing to a newsletter, publishing content and/or publishing texts on forums, participating in competitions organized by SAPOON, filling out surveys, publishing comments, sending feedback to SAPOON, requesting information about SAPOON products, or posting videos, SAPOON may request the User to provide certain information about themselves. The User is not obliged to engage in the stated activities. If the User decides to engage, SAPOON is authorized to request personal information: first and last name, address (including postal code), email address (shop@sapoon-noir.com), and telephone number.
SAPOON is authorized to use the User’s personal information to offer you products and services, organize competitions, improve the operation of the Internet Pages, enhance advertising and promotional efforts, analyze the use of the Internet Pages, improve the offer of products and services, and examine your experience with third parties. SAPOON is expressly authorized to use the User’s comments to inform other users about products. Such a comment may be published in SAPOON advertising materials on the Internet Page. In addition, if you use the Internet Pages of SAPOON to send information or products to other persons, SAPOON is authorized to store the personal information of the User and the recipient. SAPOON is authorized to use the User’s personal information for troubleshooting, performing administrative tasks, establishing contact, complying with contracts, including the Terms of Use and Privacy Statements of SAPOON Internet Pages, complying with relevant laws, and cooperating with law enforcement agencies.
SAPOON is authorized to collect information that does not identify a specific End User, including the Uniform Resource Locator (URL) of the internet page that the User visited before opening the Internet Page of SAPOON, the URL of the internet page that the User visited after leaving the SAPOON Internet Page, the type of browser the User is using, and the User’s Internet Protocol (IP) address. Authorized service providers and advertisers may automatically collect this information when visiting the SAPOON Internet Page, through “cookies” and other tools. SAPOON uses such data exclusively for troubleshooting, administering the Internet Page, analyzing trends, gathering demographic data, analyzing compliance with positive regulations, and cooperating with law enforcement agencies.
Depending on the types of activities, some information is designated as mandatory and some as voluntary. If the User does not provide mandatory information for a specific activity that requires it, they will not be allowed to engage in such activity. SAPOON will not collect personal data through its internet pages (such as first and last name, address, telephone number, or electronic address) unless the User voluntarily reports it, registers on SAPOON internet pages, or does so through a survey, by consent, and/or if permitted by applicable laws and regulations for personal data protection.
SAPOON will not share Identifiable personal information with other parties, but it may share information about Users with connected companies of the group of which SAPOON is a member.
SAPOON provides certain services and products through third parties. Third-party service providers perform certain activities on behalf of and for the account of SAPOON, such as sending and distributing SAPOON administrative and promotional email messages. SAPOON may share the User’s personal data with such Service Providers for fulfilling orders, delivering packages, sending ground mail and email mail, administering competitions, removing duplicate information on client lists, analyzing data, providing advertising services, providing search results and links, processing credit card payments, managing Internet Pages, troubleshooting, and providing customer services.
SAPOON is authorized to disclose information about the User for the purpose of protecting SAPOON and protecting others. SAPOON is authorized to disclose Identifiable personal information of the User when it is reasonably expected that its disclosure will help law enforcement or is necessary as a result of a court order, to ensure compliance with this Privacy Statement, the Terms of Use of our Internet Pages, or other agreements; or to protect property rights or safety of these Internet Pages, their Users, or other persons.
If the User does not want their personal data to be used to support customer relationships (especially for direct marketing or market research), SAPOON will respect the User’s choice. SAPOON does not sell or market personal identification data to third parties, except to SAPOON affiliates.
The User is authorized to change any personal data by sending an email message or changing the user profile. In the email message, the User is obliged to state their first and last name, address, and email address, and what information they want to update. The User can also at any time request the deletion or removal of information about their user account. The User is aware that SAPOON cannot delete information related to past transactions on SAPOON Internet Pages.
The User cannot opt-out of receiving Administrative email messages related to User activity on the Internet Page, which include messages related to specific User accounts, requests or inquiries, and messages related to the purchase of products and services. The User has the option to request promotional email messages that advertise products offered in the SAPOON Internet shop, including exclusive sales and other offers, and/or products and services of connected companies. SAPOON sends promotional email messages to registered Users who have selected the option to receive promotional messages. If the User does not wish to receive promotional email messages at any time after registering, they can choose the option to cancel receiving promotional email messages. In case of contact, the User should state their first and last name, address, email address, and what type of promotional email messages they no longer wish to receive.
For the protection of personal data from accidental or unlawful destruction, loss or alteration, and from unauthorized disclosure or access, SAPOON takes technical and organizational security measures.
The User can access personal information on SAPOON Internet Pages using a password and email address. The User is advised not to disclose the password to third parties. The User is aware of the fact that no data transmission over the Internet, or any wireless network, can be 100% secure. Although SAPOON implements commercially reasonable protective measures to protect data, it cannot guarantee the protection of any information transmitted to or from our Internet Page and is not responsible for the actions of any third party that receives such information.
SAPOON is authorized to store “cookies” on your computer containing information about the User, which are used to save the User’s time during the use of SAPOON Internet Pages, to track and direct the User’s interests with the aim of providing services tailored to each User, and for purchases. “Cookies” also collect non-personal information of the User. SAPOON may use Third-Party Advertising Agencies to display ads on the SAPOON Internet Page. As part of their service, Third Agencies may place separate “cookies” on your computer, over which SAPOON has no access or control. The User can edit browser settings to reject “cookies”, in which case it may happen that some parts of SAPOON Internet Pages may not function properly. SAPOON may also use other standard technologies to track the use of Internet Pages and promotions, and may allow Third-Party Service Providers to use this method on behalf of SAPOON.
This Privacy Statement applies only to the use and disclosure of information that SAPOON collects from Users. Other Internet Pages that can be accessed through SAPOON Internet Pages have their own statements on privacy and data collection, and methods of their use and disclosure. SAPOON bears no responsibility for the methods and operating conditions of third parties.

The GDPR (General Data Protection Regulation), namely the General Data Protection Regulation, is a European Union regulation regulating personal data protection and has been applied since May 25, 2018.
At SAPOON, GDPR primarily applies to private users who use SAPOON goods and services. However, the regulation also applies to business users where it is possible to determine which private person is in question, e.g., to craftsmen.
We always collect only those data necessary for business operations, namely those necessary to achieve a specific legitimate purpose. SAPOON never collects inappropriate data. The personal data we most frequently collect are contractual data. You gave us contractual data when concluding the contract (these are master data, e.g., first and last name, postal address, OIB (PIN), date of birth, contact details).

Application of the Policy
The Policy applies to all personal data of SAPOON users that SAPOON collects, uses, or otherwise processes.
